1) Who we are

These Terms of Service (“Terms”) govern your access to and use of the website, forms, and related services provided by Crew Life at Sea (Pty) Ltd (“Crew Life at Sea,” “we,” “us,” or “our”).

By using our website or submitting information to us, you agree to these Terms. If you do not agree, please do not use the site.

2) What we do

Crew Life at Sea is a recruitment agency that sources, screens, and introduces candidates to cruise lines, hotels, and other maritime employers (the “Clients”). We are not the employer of candidates unless explicitly stated in a separate written agreement.

  • We do not charge candidates any placement fees for job-finding services.

  • Fees (if any) for employer services are governed by separate Client agreements and are not covered by these Terms.

3) Definitions

  • Site” means our website and online forms/portals.

  • Services” means recruitment-related services, information, and communication we provide via the Site.

  • Candidate” means a person applying for a role.

  • Client” means a company/employer using our recruitment services.

  • User,” “you,” or “your” means any person or entity using the Site.

4) Eligibility & user responsibilities

  • You must be 18 years or older to use the Site.

  • You agree to provide accurate, complete, and current information (e.g., CV, documents, certifications).

  • You are responsible for keeping your contact details up to date and for safeguarding any access links we provide.

  • You must not use the Site for any unlawful purpose or to submit false or misleading information.

5) No guarantee of employment

We do not guarantee interviews, offers, visa approvals, ship assignments, start dates, or specific compensation. Final hiring decisions are made solely by Clients and can be withdrawn or changed at any time.

6) Visas, certifications, and medicals

Where roles require visas, medicals, security/background checks, maritime certifications (e.g., STCW), or other compliance steps, you are responsible for completing these and for the accuracy of documents provided. We may help coordinate information but do not provide legal immigration advice and cannot influence government or third-party decisions.

7) Candidate costs

Crew Life at Sea does not charge candidates placement fees. Certain third-party costs (e.g., medicals, visas, training, travel) may be payable to external providers or a sponsoring entity if applicable. Such costs will be communicated case-by-case and are not fees for job placement.

8) Client relationships

Where you are a Client, your commercial relationship with Crew Life at Sea is governed by a separate written agreement. If there is any conflict between that agreement and these Terms, the separate agreement controls for the scope of that relationship.

9) Intellectual property

All content on the Site (text, graphics, logos, images, layout, and software) is owned by or licensed to Crew Life at Sea and is protected by intellectual-property laws. You may not copy, modify, distribute, scrape, or create derivative works without our prior written consent.

Your content (e.g., CVs, documents): You retain ownership of your submissions. By uploading or sending content to us, you grant Crew Life at Sea a non-exclusive, worldwide, royalty-free license to use, reproduce, store, and share that content with prospective employers and service providers for recruitment and compliance purposes.

10) Prohibited use

You agree not to:

  • Interfere with or disrupt the Site or security features.

  • Attempt to gain unauthorized access to systems or data.

  • Upload malicious code, spam, or content that is unlawful, defamatory, or infringing.

  • Misrepresent your identity, qualifications, or right to work.

  • Harvest or scrape data from the Site.

11) Privacy

Your use of the Site is also governed by our Privacy Policy (POPIA-aligned). It explains what we collect, why, and how we process personal information. By using the Site, you acknowledge our privacy practices as described there.

12) Third-party links & services

The Site may link to third-party sites or services (e.g., training centres, payment gateways, video platforms). We are not responsible for their content, policies, or actions. Use of third-party services is at your own risk and may be subject to additional terms.

13) Communications & electronic records

You consent to receive communications from us electronically (email, web apps, or messaging). You agree that electronic records and signatures have the same legal effect as paper originals, where permitted by law.

14) Service changes and availability

We may change, suspend, or discontinue any part of the Site or Services at any time without notice. We do not warrant that the Site will be error-free or uninterrupted.

15) Disclaimers

To the maximum extent permitted by law, the Site and Services are provided “as is” and “as available” without warranties of any kind, whether express or implied (including fitness for a particular purpose, merchantability, accuracy, or non-infringement).

16) Limitation of liability

To the fullest extent permitted by law, Crew Life at Sea, its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or business opportunities, arising from or related to your use of the Site or Services, even if advised of the possibility of such damages. Our total liability for any claim will not exceed ZAR 2,000 or the amount you paid to us for the specific service giving rise to the claim (if any), whichever is greater. Some jurisdictions do not allow certain limitations; in that case, the limitation applies to the maximum extent permitted.

17) Indemnity

You agree to indemnify and hold harmless Crew Life at Sea from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site or Services; (b) your breach of these Terms; (c) your violation of any law or third-party right; or (d) content you submit.

18) Suspension & termination

We may suspend or terminate access to the Site at any time if we believe you have violated these Terms or applicable laws, or to protect other users or our business. You may stop using the Site at any time. Sections that by nature should survive (e.g., IP, disclaimers, liability, indemnity, governing law) survive termination.

19) Governing law & dispute resolution

These Terms are governed by the laws of the Republic of South Africa. You agree to the exclusive jurisdiction of the courts of Cape Town, South Africa. Before filing a claim, the parties will first attempt in good faith to resolve the dispute through informal negotiation (14 days) and, if needed, mediation in Cape Town.

20) Changes to these Terms

We may update these Terms from time to time. The “Last updated” date above reflects the latest version. Material changes will be posted on the Site, and continued use after changes means you accept the updated Terms.
